Divorce in Texas please help.?
My husband and I been married since 02..split in 08 (his doing’s not mine) I want to get on in life and file but he wont sign..idk what to do. The reason he wont sign is because he gets a VA check and since he is married its increased. I dont want nothing from him..he dont work so nothing to get anyhow..the only thing we share would be his truck that was purchased while we were together..he can keep it. He is living with a woman and I just dont get why he cant sign…can someone please tell me how I can go about divorce in TEXAS without him signing. ty.
As long as you have proof of service, that is, that he has signed either a WAIVER OF SERVICE or been served by a process server, you do not need his signature. If you’re doing a do it yourself divorce, prepare the petition and the final decree, do a WAIVER OF SERVICE have him sign it in front of a notary public, file the Waiver, if he refuses to sign the Waiver, then hire a process server and give the process server the Petition for Divorce and have him or her serve your husband. The process server will file proof of service. After 60 days from the date of filing the Original Petition, you can go to the Uncontested Divorce Hearing and have the Judge sign the Final Decree, have at least three copies of said Decree with you.
