ontario family law divorce
family law dealing with property division in Ontario Canada.?

I am in a middle of a Divorce. My wife and I have been legally separated for 2 yrs now and the divorce should be final in 2 months.

On our legal separation papers, she stated that the family car was to go to me.

A month age on the advice of a friend my ex-wife took back my car, that I placed in her name during our marriage, and sold it for $100.00 to a room mate that lives with her.

1.)Is she allowed to sell the car (worth $3000) for $100 to a room mate where she will still have full access to it?

2.) and is she allow to sell the car even though it was agreed that i will have it in the separation agreement also it is stated in the property section of our divorce document that is already filed with the courts?

The Fraudulent Conveyances Act makes transactions designed to deprive creditors or others of their lawful rights to property void. There may also be remedies under the Family Law Act on an application under s. 7 or 10.

This is something that I would strongly recommend speaking to your lawyer about.
