limitation period to file criminal/forgery case in ontario?

Is there any time bar on filing a criminal case?
My wife first took the Divorce without sending me any notice. I do not have any record. Then she sold the joint property, signing forged signature on my power of attorney, when I was out of country.
When I came back I was surprised to note that I have no place to live. I stayed in Motel and contacted a lawyer. He sent the notice to her. Then my elder son came and told me not to file a suit in court. She will sell the property and return your amount. Every time when I asked my wife about amount she has so many excuses. Now it is ten years and I have no money, no job and no place to live. It is a matter of $ 250,000 Canadian Dollars. As it is a criminal offense, can I file a case now.

For indictable offences, there is no limitations period at all, so criminal proceedings for fraud and forgery could be initiated at any time.

But that doesn’t do you much good if you’re looking to try to sue to try to get your money back.

There is a mechanism for private prosecution of criminal offences in Canada. (See, for instance, s.507.1 of the Criminal Code.) However, it isn’t frequently used, because there isn’t much to be gained through it. Criminal proceedings are all about punishing the offender; restitution is a relatively unlikely order in such a matter – you’d need to pursue your remedies in a civil court. And civil actions *do* have limitations periods. For tort claims discovered prior to January 1st, 2004, an action had to be brought within six years. For claims discovered on or after that date, the limitations period is two years.

As far as court steps she actually took go – like not giving you notice of a Divorce Application – it isn’t really the limitations period that affects those, because there was a court proceeding. However, setting aside such orders requires a certain amount of diligence; a person needs to show that they acted expeditiously when they learned of the Order they’re trying to have set aside.
